Photoshoot Terms and Conditions

 

Before confirming your photoshoot booking, please ensure that you have read these terms and conditions carefully. 

    1. Definitions

For the purpose of this agreement the 'Photographer' is Devrim Celibi and the 'Client' refers to the Photographer's client, which may be a direct client booking via The Turquoise Collection and/or a customer of The Turquoise Collection Ltd. "Photographs" means all Photographic material furnished by the Photographer, whether transparencies, negatives, prints or any other type of physical or digital material.

    2.  Copyright

All original negative/digital material remains the property of the Photographer. The Photographer retains the entire copyright in all the Photographs created by the Photographer at all times throughout the world.

The Client agrees that any Photographs produced by the Photographer may be submitted to any Photographic exhibition or competition, or to any newspaper, magazine or other periodical, or Photography books, and published on the Photographer's website. blog and other websites or blogs, or by any other means, with a view to publication, display in a portfolio of work, or otherwise used by the Photographer to promote her business.

    3.  Ownership of materials

Title to all Photographs remains the property of the Photographer

    4. Use

The Client is granted a Licence enabling them to utilise the Photographs for their private non-commercial use only. There are no limitations to the Client's own non- commercial use.

The Photographer's permission must be obtained by the Client before any use of the Photographs for other purposes. Permission to use the Photographs for purposes outside the terms of the Licence will normally be granted upon payment of a further fee, which must be mutually agreed (and paid in full) before such further use. Unless otherwise agreed in writing, all further Licences in respect of the Photographs will be subject to these terms and conditions.

The Photographer reserves the right to use one or a selection of Photographs from your shoot in any and all forms of media, for the purpose of self-promotion (Facebook, blogging etc), publicity, publishing, resale as prints or other media for commercial use, or in Photographic contests or gallery shows. This includes stock sites. In addition The Turquoise Collection Ltd. may use the Photographs produced during your photoshoot for marketing purposes with the Photographer's permission. 

No Photographs containing personal data such as a personally identifiable natural person will be used for this purpose by the Photographer or The Turquoise Collection without prior written consent from the individual/s. 

    5. Liabiliy

Waiver of liability: client expressly releases the Photographer, her employees and agents from all claims, damages, and liabilities that may result from accidents or incidents that occur during the photoshoot. This waiver of liability includes waiver of any claim that may be a result of negligence.

The Photographer warrants and declares that every effort will be made to provide high quality Photographic services. In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative Photographer. The Photographer will make every effort to secure a replacement Photographer able to provide a similar package as chosen on your booking confirmation at the same/similar tariff.

If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the photoshoot package.

In the unlikely event of The Client's Photographs being lost, stolen or destroyed for reasons within or beyond the Photographer's control, liability is limited to the return of all payments received for the photoshoot package.

    6. Data protection

The Client's and additional subjects (partner/friends/family) will appear in the Photographs taken by the Photographer as a part of the photoshoot of their holiday in Turkey. In providing this service the Photographer creates Photographs which may identify the Client and additional subjects (partner/friends/family) and that may be considered personal data.  The Client is responsible for ensuring that all participants in a Photography shoot have been provided with a copy of these terms and conditions and Privacy Policy.

All personal data that the Photographer and The Turquoise Collection Ltd. may use will be collected, processed, and held in accordance with the provisions of the General Data Protection Regulation ("GDPR") and your rights under this legislation. Further details can be found here: Privacy Policy.

    7.  Payment

A non-refundable deposit payment of £100 by the Client will be required at the time of booking. The remaining balance will be due 12 weeks before the holiday departure date. Failure to pay by the due date on your invoice will result in cancellation of your photoshoot and loss of deposit.

    8.  Expenses

If the photoshoot location involves an entry fee, this will be payable by the Client.

Where extra expenses or time are incurred by the Photographer as a result of alterations to the original package booked by the Client, or otherwise at their request, the Client shall give approval to and be liable to pay such extra expenses or fees to the Photographer.

    9.  Rejection

Unless a rejection fee has been agreed in advance, there is no right to reject on the basis of style or composition.

    10. Cancellation & postponement

A booking is considered firm as from the date of confirmation and receipt of non-refundable deposit payment of £100 from the Client at the time of booking. The remaining balance will be due 12 weeks before the holiday departure date. Failure to pay by the due date on your invoice will result in cancellation of your photoshoot and loss of deposit.

In the event of a cancellation for the photoshoot where the booking is cancelled prior to 12 weeks before the scheduled booked date for the photoshoot, the cancellation fee is limited to the non-refundable booking deposit.

If a booking is cancelled within 12 weeks of the scheduled booked date for the photoshoot, a further cancellation fee of £50 is payable by the Client in addition to the non-refundable booking deposit. Anything paid above this would be refunded to the Client.

If the Client's holiday has to be rescheduled as a result of travel not being possible due to government restrictions, the photshoot may also be re-scheduled (subject to availability). In this instance the non-refundable booking deposit paid for the photoshoot would be transferred to the new scheduled booking for the photoshoot and no cancellation fee would be charged to the Client.

    11. Archiving

The Photographer shall only remain responsible for archiving Photographs for 12 months after the date of the photoshoot. The Client should treat the delivered Photographs carefully and in case of digital files it is recommended that the Client keeps a safe copy on their own devices.

    12.  Applicable law

This agreement shall be governed by the laws of England & Wales.

    13.  Variation

These Terms and Conditions shall not be varied except by agreement in writing.
